One Response to Iowa SCT Dismisses Disciplinary Complaint Against Sac and Fox Attorney–Take Two

A complaint against an attorney should be handled in the forum WHERE the dispute arose. Here, the Tama tribal court (dispute over software etc).

Simply, state courts or disciplinary agents tend to disregard tribal law and
authority, which should be the forum to resolve the dispute. THis is contrary to Williams v. Lee USSC l959 (state court would infringe on tribal authority).

Unfortunately, mad people often file a bogus grievance against an Indian
attorney (or white attorney who handles Indian cases), as a revenge tactic.
THis burns up needless time and expense, and drags an attorney thru the
mud. Lastly, the Iowa court found no violation – and in doing so, brushed off the Comity argument (matter should be handled in Tama tribal court).
