    Tough case because tribal council approved ROWs to let company put in oil pipeline. Then when project 99% done, the council issued a stop order. They were sued and judge will likely rule against the tribe. Tribe claims lakebed but using this as a ‘defense’ is problematic.

    The scary part is another pipeline HESS Hawkeye oil pipeline is being built about l5 miles north 0r upriver on the Missouri. The FEDS allows reuse of l959 pipeline and may be an oil leak in a few years. The HESS pipeline is the one the tribe should have fought, but did not.
